We are a boutique appellate practice that handles cases at the district court level and beyond for Social Security Disability appeals litigation. We will zealously represent you in federal district court in your fight to appeal the Social Security Administration’s improper denial of your disability benefits. We will assist claimants, as well as attorneys and non-attorney representatives, who need an experienced disability appeals attorney to handle the federal court case.

Our primary goal is to help you get the benefits you are entitled to receive.

WHAT YOU NEED TO KNOW ABOUT SOCIAL SECURITY DISABILITY APPEALS IN FEDERAL DISTRICT COURTS

If you have received a denial of disability benefits from the Social Security Administration, it is time to contact our office for legal help. Our law firm is skilled and experienced attorneys who handle appeals in the federal court system.

This is important because federal court cases are different, complicated, and time consuming. Our attorney will handle everything from beginning to end, including

1

Filing the complaint and taking care of the service of process

2

Analyzing thousands of pages of your medical records

3

Researching and preparing a 25 to 35 page opening brief to set out the reasons why you were wronged

4

Researching and preparing a 15 to 20 page reply brief refuting Agency claims

5

Filing objections or motions necessary to defend your claims

6

Presenting oral argument before the district and circuit court

If you've received a benefits denial letter from the Social Security Appeals Council, you must appeal in federal court within 65 days to challenge it. It's crucial to have legal representation experienced in Social Security appeals. Ignoring the denial may jeopardize your ability to maintain your original filing date. Contact us to preserve your rights and filing date. Winning the appeal could mean recovering back pay benefits and gaining Medicare coverage if eligible.

WHY YOU NEED AN ATTORNEY FOR YOUR DISTRICT COURT APPEAL?

At the Agency level, you have a choice as to your representation. You are able to work with an attorney or even a non-attorney representative at the Agency level. However, you must be represented by an attorney when litigating an appeal in federal court.

WE HANDLE CASES NATIONWIDE

We handle cases nationwide. Reach out to us to see if we can assist you with your claim. We'd love to discuss your case and how we can help you.

Agency Level

AGENCY LEVEL

The process of applying for disability benefits involves four main stages. Roughly 60% of claims are denied in the initial stage. However, chances improve with an appeal. After a denial, you can file for Reconsideration, followed by a hearing with an Administrative Law Judge if needed. Further denial leads to review by the Appeals Council. Each stage has critical deadlines, and understanding your legal rights is essential. We're here to guide you through each step and help you make informed decisions.

APPEALING UNFAVORABLE ADMINISTRATIVE LAW JUDGE DECISIONS

The majority of Social Security Disability claims are denied by ALJs. If your application for benefits has been denied by the ALJ, you should not allow yourself to feel discouraged or decide to give up pursuing your SSD benefits. The next step in the process is filing an appeal with the Appeals Council. While this often leads to another denial, it’s a necessary step before you can go to federal court review.

REPRESENTATION BEFORE THE SSA’S APPEALS COUNCIL

After being denied disability benefits by an Administrative Law Judge, the next step is to appeal to the Social Security Administration's Appeals Council. This appeal must be filed within 65 days of the ALJ's decision. If the Appeals Council appeal is unsuccessful, the final option is to file an appeal in federal district court within another 65 days. Having an attorney can be helpful during these steps. Federal court provides an unbiased platform for reviewing ALJ rulings.

CHALLENGING ADMINISTRATIVE LAW JUDGE ERRORS

One of the more common approaches for overturning ALJ decisions is reviewing the most current federal court case decisions and rulings. We use this approach to expose ALJ errors that we can argue to get your decision overturned. This approach, along with many other legal strategies, improves the chances of a victorious appeal on your behalf. We work hard to keep up to date on the most recent federal court case decisions and rulings to improve your chances of overturning erroneous ALJ decisions. We’d love to talk to you about your case and how we can help.
