Can I submit new evidence treatment?
No, generally new evidence cannot be submitted as part of the federal appeal. The Federal appeal is based on what the ALJ had at the time of the decision. The court will be looking at the transcript that Social Security files that will have what the agency had, what the judge said, and then we'll determine whether that's right or wrong. Thus, a federal appeal is limited to what was before the judge at the time of the decision.
We're always happy to talk with you about your new treatment or any new conditions that come up during this time period. In the event that we are successful in your federal appeal, this new evidence will be important, and you can submit it at that time to help prove your disability case.
